Terms of Service

1. Acceptance of Terms

By accessing or using the BoomRealties platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.

These terms apply to all users of the platform including tenants, landlords, agents, and agencies. BoomRealties reserves the right to update these terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

2. Platform Description

BoomRealties is an online real estate marketplace that connects property seekers (tenants/buyers) with verified property owners (landlords) and real estate agents/agencies across all 36 states and FCT Abuja, Nigeria. The platform facilitates property discovery, messaging, viewing appointments, rental applications, and secure payment processing.

BoomRealties is not a party to tenancy agreements or property sales contracts. We provide the technology infrastructure to facilitate connections and transactions, but the legal relationship exists solely between the landlord/agent and the tenant/buyer.

3. User Accounts

You must create an account to access most platform features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information at registration.

• You must be at least 18 years old to create an account
• One person may not maintain multiple active accounts
• Accounts are non-transferable
• You must notify us immediately if you suspect unauthorised access to your account

4. Property Listings

All property listings on BoomRealties must be accurate, truthful, and not misleading. Landlords and agents may only list properties they own or have the legal right to list. The following are strictly prohibited:

• Listing properties that do not exist or are not available
• Using photographs that do not represent the actual property
• Misrepresenting the property type, size, location, or amenities
• Listing the same property multiple times
• Uploading images that have already been uploaded by another user on the platform

BoomRealties reserves the right to remove any listing that violates these terms without notice.

5. Payments

All payments processed through BoomRealties are facilitated by our payment partners: Paystack (local cards & bank transfers), Stripe (international cards), and BRLT Token (cryptocurrency on BNB Smart Chain). By making a payment on the platform, you agree to the terms and conditions of the applicable payment processor.

A platform commission is automatically deducted from all successful transactions at the rates configured by the platform administrator. Current rates are: 5% of first month's rent for rental transactions, and 2% of sale price for property sales. These rates may be updated by the administrator and the applicable rate at time of transaction is binding.

7. Commission Structure

BoomRealties operates on a commission-only model with no listing fees. Commissions are deducted automatically at the point of payment:

• Rental transactions: 5% of first month's rent (configurable by admin)
• Sales transactions: 2% of agreed sale price (configurable by admin)
• The commission breakdown is clearly displayed to all parties before any transaction is confirmed
• Commission applies equally to fiat (Paystack, Stripe) and cryptocurrency (BRLT Token) transactions, calculated on the Naira-equivalent value

8. Verification

Landlords and agents must complete identity verification before their listings are published. The Verified badge indicates that BoomRealties has reviewed and approved the submitted identity documents. Verification does not constitute an endorsement of the property, the landlord, or the agent. Users should always exercise due diligence.

9. Prohibited Conduct

Users may not engage in any of the following:

• Fraudulent listings, identity fraud, or misrepresentation of any kind
• Harassment, abuse, or threatening behaviour toward other users
• Attempting to circumvent platform payments by transacting directly to avoid commissions
• Scraping, crawling, or automated access to the platform without written permission
• Uploading malicious code, viruses, or any content that disrupts platform operations
• Using the platform for money laundering, financing of illegal activities, or any other unlawful purpose

10. Limitation of Liability

BoomRealties provides the platform on an "as is" basis. To the maximum extent permitted by law, BoomRealties shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform. Our total liability in any circumstance is limited to the commission amount received by BoomRealties for the specific transaction in dispute.
